RE: Interim Finances and Conduct

I am writing to confirm some changes to the payments to your client and the reasons.

Firstly, as you are aware due to the break- up of (company) your client has been made redundant. Her final pay and redundancy has been paid into the joint account at the Halifax. This account has been put into an overdraft situation of almost £1000 by your client since March 2005. Despite my efforts to have my name taken off this account your client has deliberately blocked this and written to the bank to tell them she is not happy for my name to be removed even though this was her original request. I have now put a stop on all withdraws on this account and suggest your client transfers sufficient funds to make up the shortfall so it can be closed.


Further, last week I discovered that despite the agreement reached between us for interim maintenance of sufficient amounts to cover the mortgage and ensure payments on (Home) continued, your client has not paid the mortgage since April and it is now five months in arrears.


It would seem clear from your clients actions and conduct since separation that she aims to try and embarrass me financially, as well as destroy my reputation with family and friends as a result of the messages they have received and passed on to me. Further the comments made to our daughter in regard to my actions and support are totally inappropriate and will be raised with CAFCASS.


As you are fully aware, I am in a very precarious financial position following the break-up of (theCompany) and the requirement to borrow as a result of your clients removal of £30,000 from the joint account. I am therefore saddened that knowing this, your client would further impact our daughter’s security by defaulting on the mortgage. Moreover it is now clear that money earned during our marriage was diverted to personal accounts and is now being used on foreign holidays. I understand your client is planning to travel abroad again in October. I believe this is the fifth such trip since our break-up!


As a result and taking into account all these factors, I have no choice but to action the following changes from 1 October 2005:

Ø I will be taking over responsibility for the mortgage and will pay this directly to HBOS.

Ø I will pay H’s school fees direct to (the School) by direct debit.

Ø I will pay directly to your client £500 per month to cover child maintenance as per the CSA guidelines. This is paid to cover all H’s needs and does not preclude additional payments for major purchases. Your client should inform me in writing of any major purchases and the reason these fall outside basic needs and I will then if agreed, purchase the said items personally and have them delivered.

Ø I will not pay any other monies to your client as it is clear that she has been compensated quite sufficiently for her endurance and suffering as evidenced by the form(e)

It is with great regret and continued disappointment that I am forced into this course of action.
